Terms of Service
Effective date: October 9, 2026
These Terms of Service govern your use of apexbusinessmarketing.com and ApexSEO software and related features provided by Apex Business Marketing (“Apex,” “we,” “us,” or “our”). By using the services, you agree to these terms. If you do not agree, do not use them. A separately signed service agreement or order controls its specific services, pricing, and conflicting provisions.
1. Eligibility and account authority
You must be at least 18 and legally able to enter an agreement. If you act for a business or client, you must be authorized to bind it and manage the connected accounts and content. Keep your access credentials secure, provide accurate information, and notify us of unauthorized access. Do not share platform passwords with Apex or other users.
2. What ApexSEO provides
ApexSEO supports business marketing tasks, including supported SEO workflows and AI-assisted social-content preparation. Its current social module can generate and edit images and copy, save drafts, connect accounts through a publishing provider, and submit supported content after an explicit publishing action. Features vary by software version, platform, permissions, and provider availability. Draft or download support does not mean direct publishing is available for a particular format.
Facebook, Instagram, LinkedIn, Pinterest, TikTok, and YouTube integrations depend on the relevant permissions and approvals. We do not guarantee platform approval, uninterrupted API access, publishing success, reach, rankings, traffic, revenue, or other marketing results. ApexSEO is an independent product and is not endorsed by these platforms.
3. Connected accounts and publishing instructions
Authorize only accounts you own or are permitted to manage. A connection authorizes the disclosed features and granted permissions, not unrestricted account activity. Before selecting Publish now, review the correct client, account, media, copy, links, and available visibility settings. That action instructs us and the configured provider to submit that content. AI generation alone does not instruct us to publish.
Platform processing, moderation, outages, quotas, and permission changes can delay or reject a post. An uncertain submission can have reached the platform; check its status before trying again. The current social module does not provide automatic scheduled posting. Revoking an integration stops future access but does not retract previously published content.
4. Your content and AI output
You retain the rights you have in your submitted content. You grant Apex and its service providers a limited permission to process, store, adapt, generate, transmit, and display that content only as needed to provide the requested service and comply with law. You must hold the necessary rights and permissions for images, music, trademarks, likenesses, business claims, and personal information you submit or publish.
AI output can be inaccurate, incomplete, similar to other output, or unsuitable for publication. Review and edit it before use. Verify business facts, legal claims, originality, licensing, and required advertising or AI-content disclosures. We do not guarantee that AI output is unique, copyrightable, or free of third-party claims. Do not submit secrets or sensitive personal information that is unnecessary for the task. AI processing and provider sharing are explained in our Privacy Policy.
5. Acceptable use
Do not use the services for unlawful content, infringement, impersonation, harassment, fraud, deceptive reviews, spam, artificial engagement, unauthorized scraping, credential harvesting, or bypassing platform restrictions. Do not attempt unauthorized system access, distribute malicious code, or interfere with other users. Follow applicable platform community, advertising, disclosure, and intellectual-property rules. You must not use platform data obtained through ApexSEO to train general-purpose AI models or for unrelated profiling, surveillance, or resale.
6. Third-party services and platform terms
Connections and publishing may use Ayrshare; requested image/copy generation uses OpenAI’s API. Third-party providers operate under their own applicable terms and privacy policies. You are responsible for compliance with the terms of your connected accounts, including Facebook, Instagram, LinkedIn, Pinterest, and TikTok.
By using ApexSEO features that use YouTube API Services, you agree to be bound by the YouTube Terms of Service. Google’s handling of information is described in the Google Privacy Policy. These terms do not grant permission to bypass platform review, obtain unavailable scopes, or publish unsupported content.
7. Privacy and deletion
Our Privacy Policy explains information collection, AI processing, providers, storage, retention, and your choices. You can revoke platform permissions and request deletion using the data-deletion instructions. Where you manage a client’s workspace, you must provide appropriate notices and obtain the authority and consents required to process its information. Acceptance of these terms does not replace an authorization or consent required for a specific integration.
8. Fees and service scope
Applicable pricing, payment dates, usage limits, renewal, cancellation, and refund terms are those disclosed in your order or service agreement. Third-party subscriptions and API usage may be charged separately under your provider agreement. These terms alone do not enroll you in a paid subscription or authorize a new charge. Contact us about your particular plan before purchasing or enabling chargeable usage.
9. Suspension and ending use
You may stop using the software and revoke connections at any time; cancellation of a paid service follows your applicable agreement. We may restrict or suspend access where reasonably necessary to address misuse, security concerns, legal requirements, nonpayment under an agreement, or platform restrictions. We will provide notice where reasonably practicable. Keep copies of content you need and request deletion of records when ending a service.
10. Service limitations and responsibility
To the extent permitted by law and subject to any written service commitments, the services and AI output are provided as available, without guarantees of uninterrupted or error-free operation or fitness for a particular result. You remain responsible for reviewing and approving your marketing content. Neither party excludes liability that applicable law does not permit it to exclude. Any liability limits agreed in a separate service agreement apply according to that agreement; statutory consumer protections remain unaffected.
11. Updates and questions
We may revise these terms to reflect changes to services or requirements. We will update the effective date and provide additional notice or obtain agreement where required for material changes. Contact us first to discuss service issues, privacy requests, or concerns. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
